History and Organization

Montgomery County Utility District No. 3 (MCUD#3) was created in 1971 by an Act of the Texas Legislature, now codified in Chapter 8302 of the Texas Special District Local Laws Code, as amended. It operates as a municipal utility district under Chapters 49 and 54 of the Texas Water Code and other laws. It is governed by a five-member, elected Board of Directors. It is subject to the continuing supervision of the Texas Commission on Environmental Quality.

MCUD#3 contains approximately 452 acres, including the central part of the April Sound subdivisions, in northwestern Montgomery County, on the south shore of Lake Conroe and straddling State Highway 105. See District Map, below. An adjoining district, Montgomery County Utility District No. 4 (MCUD#4) includes western and eastern parts of the April Sound subdivisions.

After annexation by the City of Conroe, in 2014, MCUD#3 and MCUD#4 have continued to operate as “limited districts,” inside the City’s limits, under strategic partnership agreements with the City, as authorized by Chapter 43 of the Texas Local Government Code and other state laws. Under those agreements and laws, MCUD#3 and MCUD#4 retained powers and functions provided by law, including water, wastewater, storm sewer, and solid waste. They both levy taxes and collect user fees. The two districts jointly own some water and wastewater facilities, including a wastewater treatment plant located south of State Highway 105.

Board of Directors

The District’s governing body is its Board of Directors consisting of five Directors elected by the voters of the District (with certain vacancies being filled by appointment). A Director must be either a qualified voter within the District or own land subject to taxation within the District. Directors serve staggered four-year terms. The Board elects its President and other officers. As of March 31, 2026, the District’s Directors and officers were as follows:
